General Terms and Conditions – MIORAÉ

These general terms and conditions apply to all offers, orders and agreements from MIORAÉ via the website https://miorae.nl .
By using this website and/or placing an order, the consumer agrees to these general terms and conditions.

2. Applicability

These general terms and conditions apply to every offer from MIORAÉ and to every agreement concluded between MIORAÉ and the consumer.
The text of these terms and conditions will be made available electronically before the agreement is concluded.

3. The offer

All offers are without obligation.
Obvious errors or mistakes in the offer do not bind MIORAÉ.
Product images and descriptions are for illustrative purposes only; slight variations in color, shape, or detail are possible.

4. The agreement

The agreement is concluded when the consumer accepts the offer and meets the conditions set.
MIORAÉ confirms the order by email.

5. Prices

All prices are stated in euros and include VAT, unless otherwise stated.
Any shipping costs will be clearly stated before completing the order.
Price changes do not affect agreements already concluded.

6. Payment

Payment must be made via the payment methods offered on the website.
MIORAÉ reserves the right to cancel an order if payment is not made or is refused.

7. Delivery

MIORAÉ will execute orders with care.
Delivery will take place at the address specified by the consumer.
Delivery times stated are indicative and not final. Exceeding these times does not entitle you to compensation or cancellation.

8. Right of withdrawal

The consumer has the right to cancel the agreement within 30 days of receipt, without giving any reason.

9. Exclusion of right of withdrawal (hygiene)

The right of withdrawal is excluded for products that are not suitable for return for hygienic reasons and whose seal has been broken after delivery.
Used products cannot be returned.

10. Returns

Returns must be registered in advance via info@miorae.nl .
Products must be returned unused, undamaged and in their original packaging.
The costs for return shipping are at the expense of the consumer, unless otherwise agreed.

11. Refund

After receipt and inspection of the return shipment, the purchase amount will be refunded within 14 days via the original payment method.

12. Use, own responsibility and liability

MIORAÉ products are intended for cosmetic and general wellness use and are not medical devices.
Use of the products is entirely at the consumer's own risk.

MIORAÉ is not liable for any damage, injury, skin reactions, allergic reactions or other consequences resulting from:

  • incorrect or improper use;

  • use contrary to the instructions for use;

  • use in case of medical conditions or skin problems;

  • use in combination with other products or treatments;

  • negligence or carelessness of the consumer.

In case of doubt or medical complaints, consumers are advised to consult a doctor or specialist beforehand.
To the extent permitted by law, MIORAÉ is not liable for indirect or consequential damages or lost profits.
MIORAÉ's liability is in all cases limited to the amount of the order in question, unless there is intent or gross negligence.

13. Warranty and complaints

MIORAÉ guarantees that the products comply with the agreement.
Complaints must be reported within a reasonable period via info@miorae.nl .
Complaints will be answered within 14 days at the latest.

14. Intellectual property

All intellectual property rights relating to the website, texts, images, logos and products belong to MIORAÉ.
Use without prior written permission is prohibited.

15. Force Majeure

MIORAÉ is not obliged to fulfil obligations in the event of force majeure.
Force majeure means any circumstance beyond the control of MIORAÉ.

16. Applicable law and disputes

All agreements are exclusively governed by Dutch law.
Disputes will be submitted to the competent court in the Netherlands.

17. Changes to the terms and conditions

MIORAÉ reserves the right to change these general terms and conditions.
Changes will take effect upon publication on the website.
